Restricted technical pilot. Restricted technical trial version — general public release is subject to authorisation by the national data protection authorities.
1. Purpose
Téou is a Live location-sharing and guidance tool. The publisher, Teou Mobility LLC (Wyoming, United States), acts solely as a technology intermediary: it connects a sender with their recipients but is not a party to the exchanges, deliveries or physical journeys carried out between users.
These terms govern the use of the Téou application (Android and web) and of the teou-app.com website. The same text, word for word, is published in the application and on the website.
2. Access to the service and deployment status
Access requires a valid phone number, verified by a one-time code. You are responsible for the confidentiality of the device on which your session is open. Téou is not intended for persons under 16 years of age.
Téou is currently the subject of a restricted technical pilot, conducted for functional and security validation purposes. The service is not marketed and is not open for subscription in any of the countries concerned until the declaration or authorisation formalities required by the competent national data protection authority have been completed there.
During this pilot, sign-in is reserved for numbers registered by the publisher on a trial list; any other number is refused before anything is sent.
By using Téou during this phase, you acknowledge that you are taking part in a technical trial: the service may be interrupted, modified or restricted at any time, without notice and without compensation, in particular to comply with a request from the competent authority of your country.
3. Loved-ones Mode
Loved-ones Mode is free. The person travelling sends a request to the person they want to meet, entering that person’s name and phone number. That person accepts or declines the request in the application; by accepting, they indicate the point where they are, and nothing else is asked of them.
Once the request has been accepted and the journey started, the person travelling shares their position, their route and their estimated time of arrival in real time with the person or persons they have designated and who have accepted, and with them only. This sharing goes through a private channel reserved for the participants of the journey. Each party may end it at any time; in any case it stops at the end of the journey.
4. Delivery Mode
Delivery Mode allows a courier to organise a round to several customers and to keep each of them informed of the courier’s arrival. The courier enters the name and phone number of each customer; each customer accepts or declines the request in the application and, by accepting, indicates the point where they are.
During a round, the courier’s position is visible to all the customers the courier has to deliver to, as soon as those customers have accepted and until the end of the round or until the courier or the customer ends it. Each customer also sees the number of stops before them and their own estimated time of arrival and then, when they are the next stop, the courier’s path towards them. They see neither the name, nor the number, nor the meeting point, nor the arrival time of the other customers. As the courier’s position is visible to all their customers throughout the round, a customer may nevertheless notice where the courier stops at other customers’ locations: by accepting a delivery request, you accept that the other customers of the same round may thus see the courier while the courier is at your location.
Subscription is not open in any country during the trial phase described in section 2. The following provisions will take effect, country by country, only once the formalities required by the relevant national data protection authority have been completed: Delivery Mode may then be offered as a paid subscription (day, week or month) whose price list depends on the country of the phone number; if the account is deleted, an active subscription would be terminated and the remaining days lost, without refund.
5. Road safety and liability
An assistant, not a driver. Téou suggests a way to reach a person (Loved-ones Mode) or to make your deliveries (Delivery Mode), with an estimated time of arrival. These directions are an aid, nothing more: you are the one who chooses your route, your speed and the way you travel, and you remain in control of your driving at every moment.
Routes to be checked on the spot. Routes are calculated automatically from OpenStreetMap map data, without any traffic information. They may be inaccurate, incomplete or out of date, go along a road that is dangerous or unsuited to your means of transport, and take no account of roadworks, closures, diversions, changes in the direction of traffic, bad weather or the actual condition of the road surface. The arrival time displayed remains an estimate. If in doubt, rely on what you see on the ground.
Traffic rules come before the application. You comply at all times with the traffic rules of the country you are in. If what you see on the road (a sign, road markings, a traffic light, an officer directing traffic) does not match what Téou indicates, the road is right: ignore the direction and carry on carefully.
When driving, whatever the vehicle (car, van, motorbike, scooter or bicycle), you undertake to:
- never hold your phone in your hand;
- place it in a suitable holder, firmly attached to the vehicle and positioned so that it obstructs neither your view of the road nor access to the controls;
- choose the destination and start the journey before setting off, while stationary, or let a passenger do it;
- stop in a safe and permitted place if you need to touch the application during the journey;
- listen to the voice guidance through the loudspeaker of the phone or the vehicle, never with earphones or an earpiece, so as to keep your eyes on the road;
- put your safety and that of other road users before any direction, any schedule and any delivery.
On foot, the same caution applies: look up from the screen before crossing, cross at the places provided for that purpose where there are any, and stop to consult the application.
In Delivery Mode, the order of the round and the times announced to customers are estimates: no schedule justifies travelling faster or taking a risk.
What the publisher undertakes. Teou Mobility LLC uses reasonable means so that Téou works properly. It cannot, however, guarantee that the service will always be accurate, complete, available without interruption or suited to every situation: it is provided “as is”, all the more so during the technical trial described in section 2.
What the publisher is not liable for. To the fullest extent permitted by applicable law, the publisher is not liable for:
- damage resulting from the way a user drives or travels, in particular accidents and offences;
- the consequences of a route or arrival time that is inaccurate, incomplete or unsuited to actual conditions, where the user has not followed the rules set out in this section;
- disputes, delays, damage or disagreements between a sender and a recipient, to which it is not a party.
What this section does not exclude. Nothing in these terms excludes or limits the publisher’s liability in the event of gross negligence or wilful misconduct on its part, for harm to life or physical integrity caused by its fault, or in the other cases where applicable law prohibits excluding or limiting liability. If you use Téou as a consumer, you retain the mandatory rights granted to you by the law of your country of residence, in particular the right to obtain compensation for loss caused by the publisher’s breach of its obligations (see also section 8).
6. Termination
You may delete your account at any time from “My account”. The publisher may suspend an account in the event of abusive or fraudulent use, in particular any attempt to locate a person without their consent.
7. Use of the teou-app.com website
The website is freely accessible, without an account. Its content is provided for information purposes and may change without notice. It is forbidden to extract or reproduce its content for commercial purposes, or to disrupt its operation (bots, mass requests, intrusion attempts).
8. Governing law and jurisdiction
These terms are governed by the law of the State of Wyoming, United States, where Teou Mobility LLC has its registered office. Any dispute relating to their interpretation or performance shall, failing amicable resolution, be submitted to the competent courts of the State of Wyoming.
This clause does not deprive consumer users of the more protective mandatory provisions in force in their country of habitual residence, nor of the right to bring proceedings before the courts of that country where the law so provides.
It does not apply to the protection of personal data. For such processing, the publisher recognises the application of the law of the user’s country of residence and the competence of that country’s national data protection authority, listed in section 10 of the privacy policy.
9. Changes
The publisher may amend these terms. The applicable version is the one published in the application and on teou-app.com on the date of use; the date of the last update appears at the top of the page.
In the event of any discrepancy between the language versions, the French version prevails. For users residing in The Gambia, the English version prevails. Where the law of the user’s country of residence requires another language, the version drafted in that language prevails.
